1. Scope of application
These conditions apply to all transactions concluded with the company K. ISLER AG headquartered in Winterthur.
2. Quotations
Unless otherwise agreed, our signed quotations are valid for 30 days.
3. Prices
All prices of our price list are net excluding VAT. We grant quantity discounts on request for certain items. We reserve the right to change prices.
4. Packaging and shipping costs
Packaging is included in the list prices. The shipping costs are borne by the buyer. Shipping is always carried out at the customer’s risk.
5. Payment terms
The invoices of K. ISLER AG are to be paid net within 30 days of the invoice date. Other payment terms are not valid without our written confirmation.
6. Warranty claims and notification of defects
In the event of demonstrably faulty material or delivery, in accordance with our suppliers’ provisions, the material is either replaced free of charge or its amount credited. For any claims beyond this, such as remuneration of manufacturing costs, reimbursement for damages of any kind (including third parties), etc., any liability is expressly excluded.
The recipient of a delivery is obliged to inspect it directly upon receipt and notify the seller of any defects immediately. Insofar as no notification of a defect is received 8 working days after arrival of the goods at the recipient, the goods are considered approved. Subsequent complaints are only accepted if the defects were not recognisable at the time of delivery despite proper inspection.
7. Retention of title
All goods dispatched by K. ISLER AG remain the seller’s property until payment in full and must be made freely available to the seller.
This Supply Agreement is subject to Swiss law. For all disputes arising from this agreement, the buyer and the seller acknowledge Winterthur as sole place of jurisdiction.
